Employment Rights of Persons with Disabilities: Analyzing Workplace Inclusion and Discrimination

Abstract: The present discussion is situated
within the analysis of disability employment rights and considers the level of
workplace inclusion as well as experiential reports from persons with
disabilities that show how discrimination plays out. It examines legal
structures created to shield these particular members of the population, taking
into consideration significant legislations such as the Americans with
Disabilities Act and the Equal Employment Opportunity Commission guidance along
with international aspects of disability rights in employment. Issues persist
equally concerning, often in less explicit ways, the impact of discrimination
on people with disabilities and their ability to fully participate in the world
of work. Obstacles to inclusion such as physical inaccessibility of places of
work, societal attitudes and employer ignorance are discussed in the paper. It
also discusses the best practices to support inclusive environments, featuring
organizational policies and procedures, assistive technologies, and diversity
training initiatives that advance equality. This paper highlights that
adherence to legal requirements is insufficient a positive and inclusive
corporate culture which values diversity and promotes equal opportunities for
employees irrespective of disabled status needs to be implemented.
